The Maternity (Amendment) Bill 2017 , an amendment to the Maternity Benefit Act, 1961, was adopted at Rajya Sabha on 11 August 2016; at Lok Sabha on March 09, 2017, and received approval from the President of India on 27 March 2017.
Provisions of The Maternity Benefit (Amendment) Act, 2017 effective April 1, 2017. However, the provision of cr̮'̬che facility (Section 111 A) will be effective from 1 July 2017.
The Maternity Benefit Act of 1961 protects the work of women during her labor and gives her the right to 'maternity benefits' - that is, the absence of full wages from work - to care for her child. This action applies to all companies that employ 10 or more people.

Feasibility
According to the Act, in order to qualify for a pregnancy benefit, a woman must have worked as an employee at an establishment for a period of at least 80 days in the past 12 months. Payments during the leave period are based on the average daily wage for the actual absence period.
Key Amendment
- Increasing Maternity Leave:
The Amnesty Benefit Maternity Act has increased the length of paid paid maternity available for female employees from 12 weeks to 26 weeks. Under the Amnesty of Maternity Benefit Act, this allowance can be availed by women for an extended period of up to a maximum of 8 weeks before the expected date of birth and the remaining time may be disbursed after the birth. For women who become pregnant after having 2 children, the duration of paid maternity leave is 12 weeks (ie, 6 weeks before and 6 weeks after the expected delivery date).
- Maternity leave for adopting and assigning mothers:
A 12-week maternity leave will be available for mothers who adopt children under three months from the date of adoption and also for "assigning mothers". Mother commissioning has been defined as a biological mother who uses her eggs to create embryos grown in other women.
- Works from the Main option:
The Amnesty Benefit Agreement also introduces the enabling provision relating to "work from home" for women, which can be done after the expiry of 26 weeks of leave. Depending on the nature of the job, female employees may be able to take advantage of these benefits on terms agreed with the employer.
- Cr̮'̬che Facility:
The Amendment Benefit Maternity Act creates a mandatory cr̮'̬che facility for any establishment that employs 50 or more employees. Female employees will be allowed to visit CR̮'̬che 4 times throughout the day (including rest intervals)
The Amnemen Maternity Benefits Act requires employers to educate women about the maternity benefits available to them at the time of their appointment.
Criticism
- Many social scientists argue that it will promote patriarchy because almost all responsibility for parenting is on the mother according to this amendment. The government has not announced any leave for dad.
- Many private companies can avoid giving jobs to women who may be entering a period of pregnancy because they have to give them maternity leave for up to 26 weeks.
- The law will only benefit a small percentage of women working in organized sectors who neglect the majority who work in unorganized sectors such as farmers, contract laborers etc.
